In the real case I'm basing this on, indeed, it seemed unlikely McMahon would be found liable--but he settled (rather generously) out of court rather than deal with the hassle and the PR drain. I don't think anyone could find Luthor guilty at all here (I think he's actually less liable than McMahon was!) but it could still be ugly. But once his hand is forced he'll be completely behind Dick--and Bruce knows it, I think.
... A little kid suing you over manslaughter cause the criminal justice system can't move - doesn't look good.
